EcoClaim ("the Service") is a software-as-a-service platform accessible at ecoclaim.eu that provides automated scanning of e-commerce websites for compliance with the EU Green Claims Directive (Directive 2024/XXX/EU) and related environmental marketing regulations. The Service analyses product listings, marketing copy, and environmental claims to generate compliance reports, risk scores, and AI-assisted alternative language suggestions.

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are accepting these Terms on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

To access the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Users may submit e-commerce store URLs for automated scanning. Our system crawls the specified pages, extracts product listings, marketing copy, and environmental claims, and analyses them against the requirements of the EU Green Claims Directive and related regulations.

3.2 Compliance Reports & Risk Scoring

For each scan, the Service generates a compliance report that includes an overall compliance score, identification of potentially non-compliant claims, a risk assessment categorised by severity, and screenshot-based visual audits of flagged content.

3.3 AI-Assisted Rewriting Suggestions

Where potentially non-compliant claims are detected, the Service uses artificial intelligence to generate suggested alternative language that may better align with the EU Green Claims Directive. These suggestions are provided as guidance only and do not constitute legal advice. You are solely responsible for evaluating and implementing any changes to your marketing materials.

3.4 Service Availability

We aim to maintain the Service at a high level of availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, system updates, or circumstances beyond our reasonable control. We will make commercially reasonable efforts to provide advance notice of planned downtime.

4.1 Credit-Based System

The Service operates on a credit-based system. Each scan of a URL consumes one or more credits depending on the scope and depth of the scan. Credits are allocated according to your subscription tier and do not roll over between billing cycles unless otherwise stated in your plan terms.

4.2 Subscription Tiers

The Service is available under the following tiers:

• Free Tier — Includes 2 scan credits at no cost, subject to feature limitations as described on our pricing page
• Starter (€29/month) — Monthly credit allocation and features as described on our pricing page
• Pro (€79/month) — Enhanced credit allocation and features as described on our pricing page
• Complete (€99/month) — Full credit allocation and all features as described on our pricing page

Current pricing, credit allocations, and feature details for each tier are available on our pricing page. We reserve the right to modify pricing with thirty (30) days' prior written notice.

4.3 Payment Processing

All payments are processed securely through Stripe, Inc. By subscribing to a paid tier, you authorise us to charge the applicable fees to your designated payment method on a recurring monthly basis. You are responsible for maintaining valid and up-to-date payment information. Failed payments may result in suspension of access to paid features.

4.4 Refund Policy

Due to the nature of digital services, the following refund policy applies:

• Used credits are non-refundable. Once a scan has been initiated and credits consumed, no refund will be issued for those credits.
• Unused subscription periods — If you cancel your subscription before the end of a billing cycle, you will retain access to paid features until the end of the current billing period. No pro-rata refunds are provided for partial months.
• Service failures — If a scan fails to complete due to a verified fault on our end, the consumed credits will be restored to your account.

5.1 URLs and Submitted Content

5.2 Scan Results and Reports

Scan results, compliance reports, and AI-generated suggestions produced by the Service are provided to you for your internal business use. You retain ownership of any decisions and actions you take based on these results. We retain the right to use anonymised and aggregated scan data to improve the Service, train our models, and generate industry-level compliance insights, provided such data cannot be used to identify you or your business.

5.3 Data Retention

Scan results and associated data are retained in accordance with our Privacy Policy. Upon account deletion, we will remove your personal data and scan results within thirty (30) days, subject to any legal retention obligations.

The Service, including its software, algorithms, user interface design, documentation, branding, logos, and all related intellectual property, is and remains the exclusive property of [Company Name] and its licensors. The compliance scores, flagged claims, risk assessments, and AI-generated suggestions provided by the Service are for informational purposes only and do not constitute legal advice, legal opinion, or a legal compliance certification.

Without limiting the foregoing, we specifically disclaim any representation or warranty that:

• The compliance scores or risk assessments are definitive or legally binding
• The AI-generated rewriting suggestions will ensure compliance with any specific regulation
• The Service reflects the most current version of any applicable law or regulation, as regulatory frameworks may change
• Use of the Service will prevent regulatory enforcement actions, fines, or penalties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the maximum extent permitted by applicable law, [Company Name], its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities

• Costs of procuring substitute services
• Any damages arising from unauthorised access to or alteration of your data
• Business interruption or loss of goodwill

9.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We will delete your account data, including scan results, within thirty (30) days of account deletion, except where we are required by law to retain certain information. Any unused credits remaining at the time of termination are forfeited and non-refundable.

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to sections on intellectual property, disclaimers, limitations of liability, and governing law.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will provide notice through one or more of the following methods:

• An email to the address associated with your account

For material changes, we will provide at least thirty (30) days' notice before the new terms take effect.
